论认罪认罚案件量刑建议形式的规范化
On the Standardization of Sentencing Recommendations in Cases of Confession and Admittance of Guilt

Abstract
The Criminal Procedure Law of the People's Republic of China does not explicitly define the format of sentencing recommendations in cases of confession and admission of guilt.However,judicial interpretations,particularly those from the procuratorial authorities,have explicitly required that sentencing recommendations in these cases generally involve a fixed sentence.As a result,the proportion of cases involving fixed sentencing recommendations has been steadily increasing and is approaching an extreme point.While fixed sentencing recommendations play a clear role in enhancing defendants'expectations of leniency,reducing post-confession remorse,and promoting standardization of sentencing,the unbalanced focus on fixed sentencing recommendations has also caused a range of issues.In fact,both fixed sentencing recommendations and recommendations suggesting a sentencing range have their respective merits and drawbacks.For cases involving confession and admission of guilt,the reasonable approach is to prioritize sentencing ranges,with fixed sentences serving as a supplementary option.This issue should be appropriately addressed in future revisions of the Criminal Procedure Law.关键词
