乡村振兴背景下土地经营权信托的激励与保护
Incentives and Protection of Land Management Right Trusts in the Context of Rural Revitalization
摘要
Abstract
Rural revitalization needs rural financial support,and financial revitalization serves rural revitalization.With the opportunity of financial empowerment for agricultural land reform,trust should be used as a new tool for agricultural and rural modernization,with land management rights as the qualified object.However,land management right trusts are faced with the realities of limited qualification of trustees,insufficient social capital participation and inadequate protection of farmers'interests,which have hindered their development.In order to accelerate the realization of trust-enabled rural revitalization,land management right trusts urgently need incentives and protection.As far as the subject of trustee is concerned,the purpose interpretation should be introduced to give financial institutions the qualification of trustee,and the scope of trustees should be broadened at the legal application level.In terms of social participation,the government should accelerate industrial integration,build an information service platform,implement long-term operating subsidies,and optimize administrative services to attract social capital to participate in agricultural land trust.As for the protection of farmers'rights and interests,land management right trusts should focus on the improvement of the organizational procedures of the beneficiaries'meeting and the selection system for supervisors,so as to fully safeguard the farmers'principal status through the coordinated supervision within the trust.关键词
