Typological Analysis and Judicial Application of the Crime of Aiding Information Network Criminal Activities Based on"Technical Support"and"Business Assistance"
摘要
Abstract
The dilemma in defining the nature of the crime of aiding information network criminal activities lies in the fail-ure to categorize the activities,which leads to a biased conclusion.Therefore,the activities should be analyzed from a normative and factual perspective through typological thinking,and classified into types of technical support and commercial assistance.Technical support activities have characteristics of technicality,object non-specific nature,and decentraliza-tion,while business assistance activities have characteristics of economy and concentration.The judgment of the punish-ability of activities should adhere to the subjective attribution approach.The"knowing"corresponding to technical support activities refers to"knowing in particular",while the"knowing"corresponding to business assistance activities refers to"knowing"and"should know".The boundary between this crime and the crime of fraud should be explained based on whether the perpetrator has"conspiracy",and the principle of proportionality to punishment should be adhered to in specif-ic cases.The crime of concealing or concealing criminal gains or proceeds of crime belongs to post crime and cannot estab-lish an accomplice relationship with this crime,but can form a competing relationship in specific situations.关键词
