Construction of Autonomous Driving Risk Monitoring System Under the Perspective of Criminal Law Dogmatics Theology and Its Criminal Liability

Abstract
The judicial implementation of criminal liability for autonomous driving faces difficulties in determining causal relationships and a lack of standardized allocation of responsibility.Through the examination of attribution theory and liability theory in criminal jurisprudence,it can be concluded that the core dilemma of criminal liability for autonomous driving lies in the difficulty of understanding the causal relationships in autonomous driving accidents.As a response,by constructing an"element-risk"system,the correlation between real dangers in autonomous driving can be traced,and the obligation system of analysis institutions,drivers/controllers,and host manufacturers in autonomous driving applications can be confirmed based on the danger realization process.In cases of inaction,the actual danger is transformed into normative danger,and a normative causal relationship exists between the actual harm resulting from normative danger and behavior.Based on causal relationships,this paper discusses the criminal liability of various subjects for autonomous driving accidents and autonomous driving hazards from a doctrinal perspective.It shifts the regulation of autonomous driving activities from clarifying liability for actual harm to liability for danger,further curbing the risks arising from autonomous driving activities.关键词
