Legal Regulation of Post-Mortem Reproductive Use of Frozen Embryos
摘要
Abstract
The legal status of frozen embryo for the purpose of reproduction should be defined as foetus-like living body,which has two types of compound object and subjective rights.In determining the best regulatory scheme for post-mortem repro-duction of frozen embryos,it is necessary to weigh the competing interests of the deceased,the surviving spouse,and the post-mortem reproduction of the children,especially to protect the exclusive decision power of the spouse.The most important thing is to explore the explicit consent of the deceased husband before death,so as to provide theoretical reference and path choice for sol-ving the judicial dilemma.关键词
