数字人权视阈下个人生物识别信息合理使用制度构造
The Institutional Construction of Fair Use of Personal Biometric Information from the Perspective of Digital Human Rights
摘要
Abstract
With the development of"Digital China"in the new era,digital attributes have gradually been incorporated into people's social attributes,and such biometrics as faces,fingerprints and irises have become important information for personal identities.However,when biometric technology is widely used in the fields like social economy and public security,conflict between personal private rights and national public rights arises due to the tension between the protection of personal biometric information and the protection of national interests.So how to deal with the relationship between personal rights and interests and public interests has become a thought-provoking problem to be solved urgently.In order to ensure the fair use of personal biometric information in the context of digital human rights,it is necessary to clarify first the legal attributes of personal biometric information,and then establish the criteria for the fair use of personal biometric information in China and gradually build a corresponding system to protect the legitimate rights and interests of citizens in accordance with laws so as to realize the balance between scientific and technological innovation and human rights protection.关键词
