我国数据出境安全管理的数字生态审视及其制度机制优化
The Digital Ecological Review of Data Export Security Management and Its Optimization of Institutional Mechanisms in China
摘要
Abstract
[Research purpose]From the perspective of digital ecology theory,this article elaborates on the new requirements and challenges for China's data export security management in the new era,providing theoretical support and path selection for optimizing and improving the institutional mechanisms of data export security management,with the aim of promoting safety and efficiency in the process of data export.[Research method]By reviewing and analyzing China's policies and legal documents related to data export comprehensively,tracing the institutional evolution of China's data export security management,and combining digital ecology theory to analyze the current practical difficulties faced by data export security management,this study uncovers feasible pathways for the data export security management system and mechanisms through comparison and analysis of realities at home and abroad.[Research conclusion]Based on the four core elements of digital foundation,digital capability,digital application,and digital rules in the digital ecology,China can optimize the institutional mechanisms of data export security management from four aspects in the future,in order to build a free,orderly,and secure data export environment.Firstly,it should consolidate the digital foundation and adjust the"support system"for data export security management dynamically,focusing on establishing a data export security assessment and review system,as well as a monitoring and early warning system.Secondly,it should strengthen digital capabilities and collaborate to promote the"capability network"for data export security management,with a focus on building a digital talent team and strengthening data security technology defenses.Thirdly,it should adapt to digital applications and plan the"operational mechanism"for data export security management scientifically,continuously optimizing the institutional ecosystem for data security from the dimensions of ecological cooperation,service processes,and institutional mechanisms.Fourthly,it should improve digital rules and establish the institutional framework for data export security management,continuously refining and improving the data export system,and strengthening alignment and coordination with international data rules.关键词
