"情节严重"的犯罪论体系定位与完善
The Determination and Improvement of the Criminal Theory System for"Serious Circumstances"

Abstract
"Serious circumstances"serve as a constitutive condition for crimes involving circumstances.The proper positioning and substantive interpretation of"serious circumstances"are critical issues that judicial practice must address.Currently,challenges in understanding"serious circumstances"include unclear posi-tioning within the criminal theory system,an ambiguous scope of subjective intent,and overly arbitrary con-tent interpretations.Using the crime of disrupting doping management as a reference,this study suggests that"serious circumstances"should be understood as constitutive elements of the crime,encompassing both the objective aspects of the crime and the criminal subject.While the objective facts of the crime fall within the scope of subjective intent,the actor does not need to have knowledge of the criminal subject factors.Establis-hing a systematic framework for the standardized interpretation of"serious circumstances"offers a practical pathway for the accurate application of crimes involving circumstances and provides valuable references for ju-dicial interpretations of"serious circumstances"in the crime of disrupting doping management.关键词
