The Transformation of Judicial Document Disclosure to Judicial Data Disclosure and Its Rule Construction
摘要
Abstract
The disclosure of judicial documents is an important manifestation of judicial transparency,reflects the achievements of China's judicial reform in recent years,and is conducive to strengthening the construction of judicial integrity and reducing unjust,false and wrong cases.However,in judicial practice,the disclosure of judicial documents has also exposed various problems,such as the single judgment documents,the privacy protection of the parties is not perfect.The era of legal data has put forward new requirements for judicial disclosure,and the judicial circle has gradually shown a developing trend from the disclosure of judicial documents to the disclosure of judicial data.Compared with the disclosure of judicial documents,the disclosure of judicial data covers more extensive information and has more diversified forms of disclosure,which can better meet the basic needs of comprehensive judicial disclosure in the digital age.Judicial data disclosure includes judicial system data disclosure,judicial procedure data disclosure,judicial administration data disclosure,judicial entity data disclosure,judicial statistics data disclosure and judicial responsibility data disclosure,as an"improvement"of judicial document disclosure,it can be parallel with judicial document disclosure to achieve the purpose of judicial information disclosure to the public.However,in the process of judicial data disclosure,there are value contradictions such as the phenomenon of"anti-judicial data disclosure"and data security risks.Under the premise of realizing judicial fairness and openness,it should be regulated from the legal level to ensure that judicial data disclosure is reasonable and legal.关键词
