Interpretation of the Right to Use Homestead Under the Background of Chinese Path to Modernization and Its System Effect

Abstract
Under the background of Chinese path to modernization,the right to use homestead has the characteristics of both personal and property.The central policy has repeatedly revealed the change of attitude towards the reform of the homestead system,which provides a feasible guide for the interpretation of the connotation of the right to use homestead.According to legal interpretation,in the period of low income of rural collective economic organizations and urgent demand for rural housing security,the nature of the right to the use of homestead is the legal effect of the close combination of the right to the use of homestead property and the member right of personal property,expressed as"the right to the use of homestead+the member right=the right to the use of homestead land".The promulgation of the Rural Collective Economic Organization Law provides an institutional opportunity for the independence of members'rights.The separation of the right to use homestead and the right to use homestead makes the property property attributes of the right to use homestead purified.Based on this interpretation,it ensures the integrity of the real right legal system,eliminates the personal attribute in the right to use housing land,solves the same dilemma of the personal right in the land contract management right,realizes the maximum reform benefits with the minimum reform cost,and helps accelerate the realization of Chinese path to modernization.关键词
