Legal Approaches to Climate Change Litigation Towards the"Dual Carbon"Goals
摘要
Abstract
Climate issues are closely related to the general interests of human survival and development.Facing the serious challenges posed by climate change,international community has attached great importance to climate change.In response,countries around the world have launched climate change litigation from different dimensions of protecting subjective rights and maintaining objective order.Under the backdrop of the"dual carbon"goals of carbon peaking and carbon neutrality,by drawing on relevant legislative experiences from other countries and analyzing the existing problems and challenges in the legal and policy frameworks of climate change litigation,we can pursue an appropriate legal pathway for China's climate governance.This can be achieved through enacting a specialized Cli-mate Change Response Law,establishing a preemptive risk prevention system,incorporating greenhouse gases into the category of air pollutants,and leveraging the judicial efficacy of climate change litigation.关键词
