"纪法贯通"的作用机理与规范路径
On the Mechanism and Normative Model of"Integration of Discipline and Law"
摘要
Abstract
The"integration of discipline and law"is an inevitable choice for further improving the socialist legal system with Chinese characteristics,which is particularly related to the in-depth practice and institutional upgrading of the inner-party and na-tional supervision system.There are different ways to define the concept and operational relationship between"discipline and law",and the study of the broadest definition of"discipline and law"can help to gain a deeper understanding of the conceptual and operational relationships between"discipline"and"law".Strengthening the supervision system of the Party and the state brings new institutional requirements for the integration of discipline and law,that is,the integration of supervisory responsibili-ties requires the integration of supervisory concepts,together with the integration of supervisory party rules and national laws to help improve the socialist legal system with Chinese characteristics,and the integration of supervisory systems to promote account-ability systems.The normative path of"disciplinary and law integration"ultimately needs to be manifested as its item by item in-tegration in the object,objective behavior,and responsibility system.This kind of integration will ultimately create the fusion of different types of norms in terms of elements,becoming an important support for the synergy of"discipline"and"law".关键词
