Annual Observation Report on Environmental Legislation in China(2024)
摘要
Abstract
Codification and systematization emerged as keywords in both the practical development of China's environmental legislation and its theoretical research in 2024.The fundamental legal institutions established by the Energy Law of the People's Republic of China completed the systematization of China's energy legal framework,while the revised Mineral Resources Law of the People's Republic of China enhanced core mineral resource systems such as mining rights.Additionally,multiple environmental laws are currently undergoing formulation or revision.Against the backdrop of the codification of the eco-environmental code that has commenced,these legislative developments reflect a legislative trend toward retaining environmental separate laws alongside the codified framework.The introduction of environmental administrative regulations has reinforced the legal institutional structure,contributing substantially to the refinement of the environmental legal system.Environmental departmental regulations have made progress in the construction of the administrative procedure system and the specific system in the field of energy,but issues such as the positioning of the administrative legislation still need to be further considered.Local environmental legislation largely progressed along established paths,demonstrating innovations in regional coordinated legislation,legalization of central policies,and legislative formats,while challenges persist in legislative division of labor and developmental orientation.Research in the field of environmental legislation has historically centred on the codification of the eco-environmental code,with recent contributions including studies on the rule of law in the context of climate change and the systematization of environmental law.However,research on the interpretive analysis of environmental law remains underdeveloped.关键词
