诉源治理目标下医疗纠纷人民调解机制创新研究
Research on the innovation of people's mediation mechanism for medical disputes under the objective of litigation source governance
摘要
Abstract
Since the establishment of alternative dispute resolution mechanisms,the mediation capacity has continuously strengthened,and people's mediation for medical disputes has gradually become the primary channel for resolving conflicts within the healthcare field.However,several pressing issues in practice require immediate solutions:insufficient social influence,low mediation coverage rate,inadequate mediation procedures,limited preventive measures,and a lack of professional competence of mediators.These issues have led to the failure of the medical dispute mediation mechanism to fully play a fundamental role in promoting litigation source governance.To this end,the people's mediation mechanism for medical disputes should actively pursue innovation.Under the guidance of the objective of litigation source governance,the mechanism should adhere to the people-centered approach,closely focus on the source of prevention,build professional teams,strengthen cooperation,and leverage digital technology.By constantly innovating working methods,these measures will help further advance litigation source governance,contributing to a stable and long-term judicial reform.关键词
