国际商事争端"融解决"体系的探索与完善
An Integrated Dispute Resolution System for International Commerce:Innovations and Improvements

Abstract
The recent developments in international commercial courts are poised to provide a more optimized path for resolving international commercial disputes.The newly established international commercial courts across various countries and regions,in particular,not only retain the traditional characteristics of specialization and internationalization in international commercial dispute resolution,but also introduce a novel advantage of integration.Through innovative rules concerning the establishment of jurisdiction,selection and appointment of judges,disputing parties'autonomy,and judgment enforcement,these international commercial courts integrate partial advantages of arbitration and mediation into litigation procedures,gradually forming a distinctive and more advantageous new mechanism for resolving international commercial disputes. On this basis,the China International Commercial Court(CICC)established by the Supreme People's Court of China,along with its"one-stop"diversified international commercial dispute resolution mechanism,not only aligns with the global trend of integration in international commercial dispute resolution,but also showcases China's judicial innovations and institutional advantages.The practical foundation of this"one-stop"mechanism originates from the Supreme People's Court's decade-long judicial reform in promoting a"diversified dispute resolution mechanism"within China's domestic judicial system.Through the establishment of a"one-stop"platform,the International Commercial Expert Committee,and the Coordination and Guidance Office for the CICC,the CICC provides strong institutional support for the operation of the"one-stop"mechanism.Furthermore,by deepening the integration of litigation and mediation and supporting arbitration as a dispute resolution method,the CICC actively promotes the development and operation of the"one-stop"mechanism. This paper,after analyzing the global trend of integration in international commercial dispute resolution and the operational framework of CICC's"one-stop"mechanism,proposes suggestions for improvements from three perspectives:concept,institutional framework and infrastructure development.On conceptual level,it should actively promote the innovative and distinctive concept of"integrated dispute resolution"(IDR),not only provides a more concise and imposing description of the CICC's"one-stop"mechanism but also highlights its unique advantages and characteristics.On institutional level,it should further detail the integration rules of the"one-stop"mechanism,including implementing a"case number sharing"system,strengthening litigation-arbitration integration,and establishing an"International Commercial Expert Committee Mediation Center".Meanwhile,on infrastructure level,it should strengthen the supporting infrastructure for the"one-stop"mechanism,including the establishment of"Integrated Dispute Resolution Center"(IDR Centre)or"Central Legal District"(CLD)as operational platforms and demonstration hubs. The paper argues that CICC's"integrated dispute resolution"mechanism could create a more equitable,efficient,expedient and economical system in international commercial dispute resolution.This mechanism will contribute to the global commercial dispute resolution landscape,particularly enhancing the resolution of commercial disputes within countries and regions along the Belt and Road Initiative(BRI),offering a unique and meaningful"Chinese approach"to international commercial dispute resolution.关键词
