法治视野下监管沙盒的实践审视与应然路径
Practical review and contingent path of regulatory sandbox under rule of law perspective
摘要
Abstract
In the face of the complexity and unknown nature of emerging technologies,regulatory sandbox has become an important regulatory tool for technological innovation and risk prevention,and plays an important role in China's financial science and technology innovation,automobile safety supervision and other fields.Reviewing the practice of China's regulatory sandbox,the regulatory sandbox should be improved in terms of main elements,rules,procedures and technology,so as to promote the systematisation and standardisation of the operation of the regulatory sandbox.In the future,China's regulatory sandbox also needs to enhance the legitimacy and standardisation of regulatory sandbox implementation by supplementing the legitimacy foundation of regulatory sandbox,enhancing the interaction between the subjects in the sandbox,and further clarifying the fault-tolerance space of the sandbox system.By enhancing the transparency of the sandbox and the reflection mechanism to enhance the scientific nature of the sandbox regulatory process,we can use digital technologies to enhance the efficiency of the regulatory sandbox and achieve agile regulation.关键词
