Pathways to Establishing Legal Safeguards for"Bamboo as a Substitute for Plastic"in the Context of Codifying Ecological Environment Code in China

Abstract
In 2023,China officially initiated the codification of the Ecological Environment Code,which presents an opportunity to integrate the"bamboo as a substitute for plastic"initiative into relevant laws and regulations and establish a legal safeguard framework.This paper reviews existing policies and regulations related to the initiative in China,analyzes the legal challenges in the initiative implementation,and proposes pathways to legal safeguards centering around the codification of the Ecological Environment Code.Currently,the"bamboo as a substitute for plastic"industry is facing problems such as insufficient legalization of policies,incomplete system of standards and certifications,and a lack of legal supervision mechanisms.Pathways to addressing these challenges include:1)Integrating the initiative into the Pollution Control Section of the Ecological Environment Code to translate policies into legally binding provisions;2)Clarifying specific scenarios and fields for the application of"bamboo as a substitute for plastic"products by establishing a dynamic catalog system,while improving mutual recognition mechanisms for national and international standards to enhance the global competitiveness of bamboo products;and 3)Improving legal supervision mechanisms through implementing a dynamic whole-chain supervision framework,innovating the collaborative regulation and enforcement mechanisms,and strengthening the institutional system to ensure the supervision.关键词
