摘要
Abstract
The right to education is both a fundamental human right and an important constitutional right.Since the implementation of the current Constitution forty years ago,China's education has developed rapidly and the government's protection of the right to education has become more and more adequate.The constitutional protection of the right to education in China is mainly reflected in three aspects:legislative guarantee,administrative guarantee,and judicial remedy,with a comprehensive education legislation system established gradually,some guarantee measures for education services optimized continuously and an institutional mechanism for the guarantee of right formed.Even though the considerable achievements has been made,the protection of the right to education still suffers from inadequate legislation,uneven distribution of educational resources,and difficulties in redressing rights,and therefore,we should focus on improving education legislation system,upgrading the quality of education services,and improve the system of public interest litigation in education,and play a role in constitutional reviewing in the constitutional protection of the right to education in the future.关键词
