Hybrid Variety Right Protection:Origin of Controversy,Practical Difficulties and Institutional Response in China

Abstract
Hybrids play a crucial role in modern agricultural production,and China is at the forefront globally in terms of hybrid advantage utilization and hybrid creation.Internationally,there is ongoing debate regarding whether hybrids should be protected by plant variety rights and how such protection should be implemented.Key challenges in the protection of hybrid variety rights included defining the relationship between hybrids and their parental lines,coordinating different protection mechanisms,and balancing the interests of all stakeholders involved.Drawing on the UPOV1991 text and interna-tional experiences,China could enhance its current hybrid variety right protection framework through three approaches:introducing a dependent variety system,clarifying the interplay between variety rights and trade secret protections,and establishing complementary provisions specifically for hybrid variety protection.These measures aimed to achieve an equitable balance between the rights and re-sponsibilities of hybrid breeders while fulfilling the fundamental objective of promoting breeding inno-vation through the plant variety rights system.关键词
