Dilemma and Relief of the Articulation of Administrative and Criminal Proceedings of Crimes of Manufacturing and Selling Fake and Shoddy Seeds in the View of Norms

Abstract
Crimes of manufacturing and selling fake and shoddy seeds,as statutory crimes,have the dual illegality of administrative and criminal offense.The articulation of administrative and criminal proceedings of the crime is expressed in the normative system in a basic pattern,of which the qualifi-cation is regulated by administrative law and quantification by criminal law substantively,with admin-istrative regulations playing a major procedural role.The problem with the current mechanism for ar-ticulating the administrative and criminal proceedings of the crime is that it is difficult to articulate ad-ministrative law with criminal law in terms of the criteria for determining the act and the violation of the law,and the procedures do not run smoothly enough.The improvement of this mechanism should take as its basic starting point the clarification of the legal interests protected by the law,and should be carried out in such areas as the criminalization of the basic offence,the standardization of coopera-tion between administrative and judicial organs,and the improvement of the interface between the second half of the crime.关键词
