Abstract
The development of artificial intelligence technology presents significant challenges to the law.The impact of the new features of AI technology on the law is manifested in the contradictions between rapid change and legal lag,between technological neutrality and legal value orientation,and between technological globalization and legal regionalism.These contradictions not only affect the formal and substantive aspects of the law but also pose a deeper challenge to the aim of the law.Through analysis,the essence of the challenges lies in the fact that AI technology has triggered a reshaping of the power structure,weakened the law's capacity to govern power,enabled power to gradually break through the boundaries of the law,and generated legal uncertainty,the lack of rights orientation,and the fragmentation of global governance.In the face of the legal challenges posed by AI technology,it is necessary to take the protection of rights and the promotion of human well-being as the starting points,to advocate for a model of pluralistic and shared governance to reconcile technological power and to foster a balance in the power-rights system.Only through an in-depth understanding of the characteristics of AI technology,a correct understanding of the challenges it poses to the legal system,and the formulation of legal norms in line with the laws of science,can the coordination between the development of AI technology and legal regulation be achieved,so as to form a more robust legal framework to cope with technological changes.关键词
