The Construction of a Private Law-Based System of Claims in Labor Law
摘要
Abstract
The doctrinal construction of a private law-based system of claims in labor law serves not only to better realize the legislative purpose of protecting laborers'interests but also to meet the practical demands for claim-oriented legal reasoning in labor law jurisprudence.Based on the'obligation-liability'framework under positive law,this approach adopts the distinction between performance obligations and protective obligations as its criterion.Building upon the classification of primary rights and remedial rights,claims may be categorized as either primary or remedial in nature,thereby systematically constructing a private law claims framework for both employees and employers.This construction aids in promoting the integration of labor law education and practice,advancing the application of labor laws and the study of foundational labor law theories,and facilitating the codification of labor laws.关键词
