摘要

Abstract

The algorithm-controlled working hour mechanism,from a functional perspective,serves as a human resource management approach targeting platform-based workers.Current implementations have revealed several shortcomings requiring improvement,including improper compression of working hours,lack of operational transparency,and potential discriminatory practices in the system.The analysis of why algorithm-controlled working hour mechanisms creates dil emmas in realizing platform workers'right to rest reveals three systemic deficiencies:insufficient fulfillment of state obligations in regulatory intervention,inadequate implementation of employers'duty of care protection,and deficiencies in corporate social responsibility commitments.The study argues that the realization of platform-based workers'right to rest must be anchored in institutionalized regulatory frameworks.On one hand,it is imperative to recognize the necessity of algorithm-controlled working hour mechanisms,clarify their legal status,enhance transparency in algorithmic scheduling systems,and refine relevant regulations.On the other hand,instead of imposing restrictive limits on maximum working hours for platform-based workers,the focus should shift to exploring the feasibility of classifying necessary buffer time as working hours,and embedding these revised legal standards for working time classification into the algorithmic control mechanisms.
