我国离线权保障的困境根源与建构策略
Challenges and Institutional Pathways for Protecting the Right to Disconnect in China

Abstract
As digital and information communication technologies continually advance,the boundary between workers'professional and personal lives has blurred,leading to an imbalance and even conflict between the two domains.Against the backdrop of inadequate protection for the right to rest in China,safeguarding and enforcing the right to disconnect faces even greater challenges.Thus,it is necessary to examine the relationship between the right to disconnect and the right to rest,analyzing the necessity of protecting the right to disconnect and the root causes of its current difficulties.To develop effective protection strategies for the right to disconnect in China,the study suggests a comprehensive labor rights protection plan,at the institutional level,should be developed,featuring regular evaluation of labor law implementation and enforcement effectiveness,along with mandatory compliance with working hour regulations and other fundamental labor protections.Regarding conceptual transformation,it is imperative to rectify the distorted adversarial mentality in labor-management relations and cultivate a healthy,mutually beneficial partnership between employers and employees.In terms of the protection model,the work-life balance theory should guide the long-term development of China's right to disconnect framework.As a short-term measure,adjusting corporate labor practices through increased employment costs could accelerate the realization of the right to disconnect protection.These efforts aim to promote sustainable development and shared prosperity for workers,enterprises,and the society as a whole.关键词
