The Internal Tension of"Coordination Between Digitalization and Law"in the Reform of"Efficiently Accomplishing One Thing"and Its Risk Governance
摘要
Abstract
The reform of"efficiently accomplishing one thing"aims to achieve efficient and conven-ient government services through technological empowerment and process reengineering,reflecting the dual aspects of"restriction-simplification"of administrative power.The internal tension be-tween technological empowerment and legal constraints in the operation of administrative power can be refined into two ideal types of institutional construction,namely the"digital governance type"and the"power control and supervision type".The value conflict between the two,that is,the structural contradiction between digitalization and legalization in the process of coordination,trig-gers multi-dimensional risks such as the loss of power normality,the erosion of rights and the lag of the system in the reform.In response to this,a dynamic balance governance paradigm with elastic institutions can be constructed:build a legal review framework for the exercise of power in techno-logical applications,improve the protection of the rights of participatory governance in the digital process,and establish a dynamic adaptation mechanism for laws to respond to technological innova-tion,so as to provide a systematic path that takes into account both efficiency improvement and rights protection for the reform of government services.关键词
