Revisiting the Nexus Between Defense Lawyers' Duty of Loyalty and Public Interest:A Critical Examination of the"Circular Theory"

Abstract
The preceding"dual-center model"elucidating the relationship between defense lawyer's duty of loyalty and duty of public interest is confronted with the dilemma of duty conflicts,which can be efficaciously resolved by the"Circular Theory"originating from Japan.The"Circular Theory",a derivative of the"Elliptical Theory",posits that the"duty of honesty"serves as the fundamental principle,into which the"duty of truthfulness"is integrated.The theoretical justification for the localized application of the"Circular Theory"are not only in the similar dilemmas of duty conflicts faced by the two countries and the introduction of adversarial system elements into China's Criminal Procedure Law,but also in the theory's alignment with the evolution of the professional positioning of defense lawyer in China and its responsiveness to the practical need for strengthening human rights protection.Consequently,it is imperative for defense lawyer in China to adopt the"duty of loyalty"as the primary tenet,while concomitantly integrating the"duty of public interest"into the"duty of loyalty".It is submitted that the exceptions to the"duty of loyalty"can all be substantially interpreted as defense lawyer's fulfillment of an active"duty of loyalty."关键词
