Abstract

The state has implemented the reform of gradual delay of the statutory retirement age system,which is intended to raise the original legal retirement age in China.While the new regulations provide guidance on protecting the re-employment rights and interests of the elderly,they have not specified the concrete measures and contents of such protection.Through the analysis of typical retirement re-employment disputes in judicial precedents,it is found that the focus of the disputes in these cases consistently revolves around the identification of elderly workers'laborer status,which subsequently affects the protection of their corresponding labor rights and interests.Therefore,delaying the statutory retirement age not only raises the retirement age but also classifies the extended-retirement group as elderly workers.Consequently,the more urgent mission is how to affirm the identity of the older laborer and provide the specific protective system of re-employment of the elderly.The effective ways to resolve the problems for the future are to construct the specific regulation for the re-employment of the elderly by defining the unified legal status of elderly workers,and specifying their concrete rights and obligations.This constitutes the ultimate objective that the reform must achieve.
