Abstract
The concept of ecocide has existed for half a century,yet efforts to incorporate it into the Rome Statute as an international crime have thus far been unsuccessful.In recent years,the severe climate crisis has prompted the international community to reflect on the effectiveness of existing international laws in addressing environmental and ecological governance,giving rise to the idea of incorpo-rating environmental issues into the scope of international criminal law,namely,the establishment of the crime of ecocide.In 2021,the urge of an independent expert panel on the legal definition of ecocide and support from the international community have amplified calls for this issue.Although the international community has reached a preliminary consensus on the criminalization of ecocide,signifi-cant divergences remain in its legal definition and constituent elements.Under its existing definition,the application of the crime of ecocide faces multiple challenges of legitimacy,feasibility and effectiveness.However,it is these divergences and challenges that have prompted ongoing reflections and refinements of relevant theories,making the pathway and prospect for criminalizing ecocide a research topic of significant academic importance.关键词
