Application and Development of the Precautionary Principle in the Governance of New Pollutants
摘要
Abstract
The logical premise of embedding the Precautionary Principle in the governance of new pollutants lies in the inherent conceal-ment,uncertainty and irreversibility of the risks of new pollutants,as well as the limitations of the traditional preventive principles in response to the risks posed by the new pollutants.The implication of"pollution control"in the environmental provisions of the Consti-tution,the theory of civil environmental rights and the theory of national obligations of prevention have laid the legal foundation for in-corporating the Precautionary Principle into their governance.For effective application of the principle in the governance of new pollu-tants,it is advisable to adopt the legislative approach of establishing the precautionary principle in the General Provisions of the Section of Pollution Control and Prevention in the Ecological Environment Code of People's Republic of China,taking the principle of"strong risk prevention"as a transitional version,and meanwhile a legal system in complementation with the principle should be constructed.The application of the Precautionary Principle in new pollutant governance should comply with the principle of proportionality,abide by the substantive and procedural requirements,and adopt rational risk preventive methods.关键词
