渔政机构与海警机构的海上执法协作问题研究
Research on maritime law enforcement collaboration between fishery administration and coast guard agencies

Abstract
With the rapid development of China's marine economy,especially the deepening of the reform on the marine law enforcement system,the effective collaboration between fishery administration agencies and coast guard agencies in law enforcement is becoming increasingly important.In 2023,Ministry of Agriculture and Rural Affairs and China Coast Guard jointly organized the promotion events of fishery administration and coast guard law enforcement collaboration mechanism,which further clarified the principle of"the law enforcement goals of fishery administration and coast guard agencies were the same and their work was integrated",providing a clear direction and goal for the collaboration between two institutions.It is of great significance to further explore the development of the law enforcement collaboration mechanism of fishery administration and coast guard agencies to improve the capacity of marine governance and control and build a maritime power.However,in the process of law enforcement collaboration,there are some problems,such as unclear responsibilities and authority,unreasonable allocation of law enforcement resources,inconsistent standards for case transfer,and failure to establish a unified coordination mechanism for law enforcement collaboration.In order to solve the relevant problems,this paper first summarizes the concept,necessity,manifestation,legal basis,development status and existing problems of fishery administration and coast guard cooperation in maritime law enforcement,analyzes the specific performance of the two agencies in the transfer of cases and collaboration within their respective jurisdictions,and emphasizes that the Fishery Law of the People's Republic of China and the Coast Guard Law of the People's Republic of China and other laws and regulations provide a legal basis for the collaboration between the two agencies.Countermeasures such as unifying the standards for the transfer of law enforcement collaboration cases and establishing a sound law enforcement coordination and coordination mechanism are aimed at improving the capacity of marine governance and control and building a maritime power.关键词
