Review of the European and American Carbon Border Adjustment Mechanism in the New Globalization Era and China's Response

Abstract
In the era of new globalization,the international political and economic situation has shown more complexity and uncertainty,typical of which is the anti globalization phenomenon represented by the carbon border adjustment mechanism.The carbon border regulation mechanisms are environmental protection policies on the surface,but behind them lie multiple strategic considerations such as politics and law,climate and trade,international and domestic.It has triggered conflicts in international law,which may violate the principle of common but differentiated responsibilities and relevant WTO rules;and it also has prompted developed countries such as the UK,Canada to explore and implement similar policies,which harm the interests of developing countries such as China and have an impact on the global trade liberalization order.Three strategies are proposed to address this issue.Firstly,based on the dual nature of the European and American carbon border adjustment mechanisms,actively participate in global climate and economic governance,strengthen internal unity among developing countries,and be adept at using international legal rules to safeguard its legitimate rights and interests.At the same time,we should maintain the multilateral trading system with the World Trade Organization at its core.Secondly,we will coordinate the promotion of domestic and foreign-related rule of law,pay attention to the linkage between climate governance and trade game,and build a unified legal system for China's carbon market from various aspects such as accounting,trading,and supervision.We will promote the coordination of foreign-related rule of law between climate governance and green trade from multiple dimensions such as the state,society,and enterprises.Thirdly,we should require high-level rule of law to ensure its development,and to improve the legal system in areas such as low-carbon technological innovation,green financial markets,green energy transformation,and ecological environment protection.关键词
