Copyright Law Regime for Algorithm Countermeasures to Artificial Intelligence Style Imitation
摘要
Abstract
Generative artificial intelligence(GAI)has demonstrated its powerful imitation ability in the art field,and its style imitation ability has squeezed the survival space of artists.In order to combat the style imitation of AI,researchers have developed an algorithm countermeasure to interfere with the AI's style recognition.Algorithmic countermeasures have"defensive"and"effective"characteristics and belong to contact control measures,which should be protected under copy-right law.By protecting algorithmic countermeasures,it is possible to circumvent copyright theory disputes in the field of AI,achieve a balance of interests between artists and AI companies,and allow artists to share in the incremental copyright benefits brought by AI technology.It is recommended that Article 49 of the Copyright Law be amended and improved to en-sure the legitimacy of algorithmic countermeasures under the protection of copyright law,and that the benefit distribution model brought by algorithmic countermeasures be implemented through the copyright collective management system.关键词
