商业秘密保护社会治理的检察路径反思
Reflection on the Prosecutorial Path to Social Governance of Trade Secret Protection
摘要
Abstract
As an important support for the development of new quality productivity,the protection of trade secrets faces challenges,such as deep reliance on manual labor,mechanically passive processing of individual cases,and information si-los,under the traditional social governance framework of procuratorial organs,making it difficult to meet the protection de-mands for trade secrets in the digital age.The procuratorial concept of"digital collaboration"emphasizes the use of digital empowerment to establish a technical collaboration platform,the use of system thinking to realize multi-subject collabora-tive co-governance,from individual case handling to similar case governance,from passive response to active prevention.Under the guidance of this concept,the procuratorial organ should promote the construction of the technical legitimate prin-ciple framework in the social governance of trade secrets,and exercise restraint on the data access authority and perform-ance boundaries of the digital procuratorial platform.To avoid the"secondary disclosure"of trade secrets,procuratorial or-gans can use digital platforms to set up prevention mechanisms for leakage,and make standardized settings for the scope of the examiners,the scope to know,the confidentiality obligation and the technical processing of relevant evidence related to trade secret cases,thereby effectively escort the new quality productivity.关键词
