论国家教育考试立法中的考生权利救济机制构建
On the construction of the remedy mechanism for candidates' rights in national education examination legislation

Abstract
The remedy mechanism for candidates' rights is an important component of national education examination legislation.The existing relevant institutional norms have problems such as low hierarchy,insufficient authority,lack of norms,poor connection,and internal conflicts.In the legislative context of compiling the education code,it is necessary to take the value benchmark which including the protection of the rights of candidates,establishing effectively supervise for examination institutions so that make their powers and responsibilities clearer.The remedy mechanism for candidates' rights in national education examination legislation should be constructed that is logically coherent,has complete procedures,and a rich system,and can be integrated into the Education Code system.At the legislative level,it is recommended to design the remedy mechanism for candidates' rights within the framework of the national education examination project under the"school education"section in the specific provisions of education code,emphasizing the citation rules,linking the mechanism with other laws,and optimizing the definition of concepts to promote systematic standardization.At the level of specific mechanism settings,it is recommended to include methods such as appeal and arbitration to form a more complete and coherent relief mechanism,and establish a full process remedy model that can cover before,during,and after the event,in order to better safeguard students' rights and promote the development of the national education examination system.关键词
