国家教育考试法调整范围的逻辑证成
The logical justification of the scope of adjustment stipulated in the national education examination law
摘要
Abstract
National education examinations are a pivotal system in the process of transforming individual capabilities into social resources and obtaining qualifications.They are led by the education administrative department of the State Council and organized by approved education examination institutions.They are testing activities that assess and screen candidates through on-site tests.Legislation concerning"national education examinations"should be achieved through separate legislation and must not be mixed with"national examinations for non-academic education"and"school education examinations"for"matching legislation".Taking into account the necessity and feasibility of the intervention of state administrative power,the formal integration of the external legal system,and the value integration of the internal legal system,the scope of adjustment of the"national education examination law"should be limited to the enrollment of students in the higher education stage for academic education,academic certification,and degree awarding examinations.When stipulating the types of examinations,the legislative department should adopt explicit enumerative legislation to avoid difficulties in the application of the law due to the increase in uncertain legal concepts.关键词
