轻微犯罪记录封存制度的反思与优化
Reflection and Optimization of the System for Sealing Minor Criminal Records
摘要
Abstract
Driven by the concept of preventive criminal law,the criminal circle of the criminal law shows a tight posture,the number of minor criminal shows an expansion trend,and the structure of China's criminal law has shifted from"harsh but not strict"to"strict but not harsh".Due to the predicament of the generalization of the existing criminal record system,there is a phenomenon of"inversion of severity"between the charges of minor crimes and the accompanying consequences of the crimes they bring.The large group of people involved in crime are labeled as criminals and often encounter obstacles in areas such as so-cial security and employment,making it difficult for them to smoothly return into society.Thus,this phenomenon deviates from the original intention of the legislation on minor crimes.Therefore,it is urgent for our country to establish a system of sealing up criminal records of minor crimes,guided by restorative justice.In-depth research should be conducted on issues such as the defi-nition of the scope of application within the framework of the system,the determination of examination conditions,the selection of sealing procedures,and the effectiveness of sealing,to strike a balance between public security and the basic human rights of criminals,thereby promoting the improvement of the governance system for minor crimes in our country in the new era.关键词
