Abstract
[Research purpose]The cross-border flow of data holds a crucial position in the global landscape of digital economy,and its security issues are related to multiple aspects such as national security,economic development,and human rights protection.With the help of treaty rules between countries,the cross-border flow of data enables people to safeguard their rights and interests in digital interactions.Taking this as a cornerstone,it can fully stimulate the dividends contained in data as a production factor,injecting strong momentum into economic development.It is particularly critical that,in order to effectively maintain the security of China's data sovereignty,building a solid"security line"in the digital field,and helping China move forward steadily in the global digital economic wave,it should deeply explore the threats and challenges existing in the security of cross-border data flow.[Research method]Using the SWOT analysis method,this paper analyzes the advantages and disadvantages of China's cross-border data flow policies from the perspectives of internal capabilities and external environment.Through case analysis method,taking the EU,Singapore and other areas as typical samples,it dissects the institutional flaws existing in the cases.By comparing and analyzing the governance models,laws and regulations of different areas,it identifies the deficiencies in China's cross-border data flow policies.[Research conclusion]China's cross-border data flow security is currently facing the problems of unclear definition of"data",ambiguous regulatory system,and single-form of infringement punishment.To ensure China's data security and prevent the out-of-control of cross-border data flow,it is necessary to clarify the definition of"data"in cross-border data flow.At the same time,a multilateral regulatory system should be constructed,and the infringement punishment system for cross-border data flow should be improved.It should create a healthy ecosystem for the security of cross-border data flow,further unleash the productivity of data,enhancing China's power of discourse in data security governance,and making contributions to global data security governance.关键词
