Abstract
By analyzing the background and mode of operation of the EU CBAM and its potential conflict with interna-tional trade rules,it shows that it is a policy tool to combat climate change,which also has a profound impact on the international trading system.The EU CBAM requires importers to count and declare the carbon content of their imported products,and purchase the corresponding EU CBAM certificates according to the emissions generated by the products,which essentially extends the rules of the carbon emission trading market within the EU to the field of interna-tional trade,which may fall under the jurisdiction of the WTO international trade rules.Through comparative analysis with international trade rules such as the WTO non-discriminatory treatment rules and GATT exception rules,it can be found that the EU carbon border adjustment mechanism may be incompatible with these rules in the specific implementation process,especially the most favored nation treatment rules and national treatment rules.As to whether the GATT Article 20 general exception rule can legitimize the EU's carbon border adjustment mechanism,it remains to be seen whether its unilateral trade measures in practice will cause hidden restrictions on international trade.Finally,based on the actual impact of CBAM on China,suggestions and prospects were put forward.关键词
