中国海洋牧场建设中的海域使用权问题研究
Research on sea area use rights in the construction of marine pasture in China
摘要
Abstract
With the deepening advancement of China's maritime power strategy,the construction of marine ranches has flourished,achieving remarkable results in increasing fishermen's income and enhancing fishery efficiency.As the institutional cornerstone of marine ranch construction,the legal issues surrounding sea area use rights urgently need clarification and resolution.Based on the legal definition of sea area use rights and the current development status of China's marine ranches,this paper systematically elucidates the supporting role of sea area use rights in four dimensions—basic conditions,usage duration,spatial scope,and financing functions—for the development of marine ranches.It focuses on analyzing three core contradictions in current marine ranch construction:restricted acquisition pathways(complex approval procedures and stringent transfer conditions),conflicts in scope definition(enforcement challenges regarding unauthorized sea area use),and mortgage financing risks(operational instability and difficulties in liquidation).To address these issues,three optimization pathways are proposed:first,simplify-ing approval procedures and establishing a record-filing system for sea area use right transfers;second,strengthe-ning dynamic sea area monitoring and interdepartmental joint law enforcement;and third,improving marine aqua-culture insurance and the auction mechanism for sea area use right mortgages.Through institutional innovation,synergistic interaction between sea area use rights and marine ranch construction can be achieved,providing legal safeguards for the sustainable development of China's marine ranches.关键词
