Abstract
[Research purpose]In the process of advancing the construction of the international center for technology and innovation in Shanghai,it is necessary to persist in deepening institutional and mechanism reforms,taking institutional innovation driving and safeguarding technological innovation as the grip,and fully leveraging the important role of the rule of law in protecting scientific and technological innovation,sci-tech property rights,and other aspects.Optimizing the sci-tech legal environment is an important pathway for Shanghai to accelerate the construction of the international center for technology and innovation with global influence;a superior sci-tech legal environment is an important safeguard for Shanghai to accelerate the construction of that center.Therefore,exploring the countermeasures for improving the legal environment for scientific and technological innovation in Shanghai is of great significance to accelerate the construction of the international center for technology and innovation with global influence.[Research method]By analyzing the status quo of Shanghai's sci-tech innovation legal environment and addressing new challenges arising from emerging technological developments alongside evolving legal requirements,this study comprehensively examines shortcomings and optimization opportunities across legislative,judicial,law enforcement,legal discipline development,and talent cultivation dimensions.[Research conclusion]It proposes six countermeasures and suggestions for optimizing Shanghai's sci-tech legal environment.First,it proposes to formulate the"Regulations on Shanghai,Zhangjiang National Independent Innovation Demonstration Zone"by benchmarking against other domestic independent innovation demonstration zones.Second,it proposes to advance legislation in emerging sci-tech fields in Shanghai to establish a robust legal system for science and technology.Third,it proposes to promote the state to improve the top-level design of sci-tech legislation,compiling a"Science and Technology Code of the People's Republic of China".Fourth,it proposes to promote the joint establishment of a"Yangtze River Delta Science and Technology Court"by the Yangtze River Delta region,strengthening judicial safeguards for scientific and technological innovation.Fifth,it proposes to strengthen innovation in regulatory law enforcement in Shanghai's sci-tech fields,improving law enforcement safeguards for sci-tech-related cases.Sixth,it proposes to strengthen the construction of Shanghai's sci-tech law disciplines and sci-tech legal talent teams,strengthening theoretical and talent safeguards.关键词
