《生态环境法典(草案)》"总则编"评析:统领功能的实然与应然
Critical Analysis of the"General Provisions"in the Draft of Ecology and Environment Code:Overarching Function Between Reality and Ideal

Abstract
The"General Provisions"serve as the overarching framework of the Ecology and Environment Code,unifying all specific books through three core functions:value-oriented guidance,governance framework construction,and fundamental institutional integration.the draft of The Ecology and Environment Code of PRC preliminarily articulates the value of harmonious coexistence between humans and nature through legislative objectives,core definitions,and fundamental principles.However,it requires refinement in the legal translation of policy language,defining the scope of"ecology and environment",and systematizing fundamental principles with clear criteria.While covering key aspects of the modern ecology and environment governance framework,the draft of The Ecology and Environment Code of PRC remain fragmented,lacking structural coherence.Enhancements should strengthen regulations for enterprise accountability and judicial safeguards,clarify inter-departmental responsibilities,and explicitly recognize environmental rights as collective human rights.The draft of The Ecology and Environment Code of PRC consolidates cross-cutting systems,such as planning,standards,monitoring,impact assessments,and emergency response protocols,into the General Provisions,achieving formal integration.To attain substantive integration,it should refine logical frameworks for institutional design,establish systematic extraction criteria,and complete the substantive institutional integration.关键词
