《生态环境法典(草案)》"污染防治编"的评析与完善
Analysis and Improvement of the"Pollution Control Section"of the Draft of Ecology and Environment Code
摘要
Abstract
After adopting the approach of"extracting common factors",the"Pollution Control Section"of the draft of The Ecology and Environment Code of PRC has been restructured to include a General Provisions section and eight other sections.It incorporates the main provisions of existing single laws in the pollution control field.By adding,optimizing some systems,and responding to practical needs,it fills the gaps that were present in the original single laws.In comparison,declarations of encouragement and support from the original single laws have mostly been incorporated into the"General Provisions",while the"Pollution Control Section"focuses on regulating polluting entities through the addition,improvement,and transfer of systems,as well as elevating the legal status of these systems.This section is described as being centered around regulation.This article follows the main thread of the"General Provisions-Various Sections"highlights and improvement strategy,organizing the internal optimization logic of the main institutions of the"Pollution Control Section"and identifying their shortcomings.关键词
