生态系统方法视野下的《生态环境法典(草案)》"生态保护编"
The"Ecological Conservation Book"of the Draft of Ecology and Environment Code in the Light of Ecosystem Approach

Abstract
Codification is a key opportunity to address the fragmentation of ecological governance.The draft of The Ecology and Environment Code of PRC aims at ecosystem governance,establishes the principle of"persisting with a holistic and systematic approach to conserving and improving mountain,water,forest,farmland,grassland,and desert",and builds a systematic framework that integrates ecological elements,space,ecosystem structure and function,covering prevention,protection and restoration.From the perspective of ecosystem approach,the general provisions of the"Ecological Conservation Book"in the draft of The Ecology and Environment Code of PRC shows the conceptual highlights of ecological integrity protection,ecological carrying capacity maintenance,priority for natural-based solutions,comprehensive management,collaborative governance and adequate incentives.In terms of specific provisions,the Book makes feasible decisions through tailored institutional arrangements,guarantees the priority of economical natural-based solutions,builds institutional systems and implementation mechanisms under holistic directions,improves information collection and processing systems,implements adaptive management,as well as perfects responsibility and incentive mechanisms,to meets the institutional requirements of the ecosystem approach.Meanwhile,the"Ecological Conservation Book"of the draft of The Ecology and Environment Code of PRC still contains problems such as the separation of resources laws and ecological protection laws in chapter arrangement,imperfect coordination and information mechanisms,and insufficient co-governance,which need correction,supplementation,and optimization to enhance the operability and practical effectiveness of the Code and to provide a model for global ecological rule of law.关键词
