The System Innovation and Standardized Development of"Green and Low-Carbon Development"in the Draft of Ecology and Environment Code

Abstract
As a core division of the draft of The Ecology and Environment Code of PRC,the"Green and Low-Carbon Development Division"plays a significant role in driving sustainable economic development and has outstanding theoretical research value in terms of system innovation and normative development.Regarding the system innovation of the"Green and Low-Carbon Development Division"at the external system level,it breaks through the traditional dual structure of the ecological and environmental legal system centered on"pollution prevention and control"and"ecological protection",and needs to strengthen the system connection with the"Pollution Control Section"and the"Ecological Protection Division".At the internal system level,it takes circular economy as the normative starting point,green and low-carbon energy transformation as the core category,and climate change response as the international extension path,and needs to deepen the institutional connection with relevant single laws.Regarding the normative development of the"Green and Low-Carbon Development Division",at the normative adjustment level,its functional positioning and clause attributes show a coordinated transformation trend from rigid governance to flexible governance,and it is necessary to broaden the internal and external transformation channels of the rigid and flexible governance mechanisms.At the normative integration level,the objects it covers and the effects it produces reflect an overall elevation from single elements to domain systems,and it is necessary to further promote the systematic improvement of the green and low-carbon development legal system.关键词
