论《生态环境法典(草案)》中生态环境损害诉讼条款体系
On the System of Ecological Damage Litigation Provisions in the Draft of Environmental Code

Abstract
Articles 1066,1067,and 1068 of the draft of The Ecology and Environment Code of PRC respectively provide for consultation and litigation on ecological damage compensation,marine ecological damage litigation,and environmental civil public interest litigation,forming a preliminary system of ecological damage litigation provisions.These three ecological damage litigation provisions all aim to compensate for ecological damage in the legal sense,but there are significant differences in the normative basis for the eligibility of litigation subjects.The characteristics of the system of ecological damage litigation provisions in the draft of The Ecology and Environment Code of PRC are not clear enough,the consultation and litigation subjects for ecological damage compensation are not appropriate,and the preventive function of environmental civil public interest litigation is lacking.Therefore,it is suggested to add the phrase"causing serious ecological damage"in all three provisions,clarify"local people's government"in the provision for consultation and litigation on ecological damage compensation,and add"or posing a significant threat to social interests"in the provision for environmental civil public interest litigation,in order to help form a system of ecological damage litigation provisions with Chinese characteristics.关键词
