Abstract

Under the background of the implementation of the Yangtze River Protection Law,the judicial determination of illegal fishing of aquatic products in the Yangtze River Basin faces three challenges:ambiguous legal interests,lack of quantitative standards and conflicts in the application of pre-existing legal norms.The solutions should be based on the principle of the unified legal order,coordination of the relationship between various prerequisite laws,and application of the theory of quality differentiation:concretize the criminal legal interests into"aquatic resource security"and"water ecological environment rights and interests",and clarify the value of ecological legal interests;establish a damage assessment system based on factors such as ecological destruction and rare species,and combine the harmfulness of behavior with subjective malice to form a criminal violation benchmark;establish a collaborative mechanism between administrative evaluation and judicial judgment,linking with the standards for prosecution and conviction.By promoting the unification of execution recognition standards through multidimensional collaboration,we can ensure the stability of the ecological environment in the Yangtze River Basin and achieve the goals of coordinated development of various departments and green ecosystem development.
