The Basic Encounters of Rights in the Digital Society and the Response Logic

Abstract
Rights are facing a series of new challenges in the digital society,calling for new response logic.With the emergence of digital private power,the survival of rights,as a modern way of life,has found itself involved in a dual-front battle,where,besides dealing with public power,it has to step out to resist the covert analysis and control by digital private power.The expansion from physical space to virtual space based on digital technology promotes the division of the holders of rights into inner subjects and outer subjects,which means that it is difficult for both the individual outer subjects and the class subjects as remaining life to get rid of the situation of being deprived.In addition,with the rapid expansion of the digital society,the right structure,i.e.,the possibility of the subjects exercising rights,and the right to claim and the right to relief,is experiencing a systemic challenge from the freedom paradox of"empowering and reducing the rights"to the risk of uncertainty.In response to the basic environments of rights,it is necessary to establish the basic conception of prioritizing human dignity over consequences,focus on building a multi-dimensional system pattern based on individuals,platforms,and governments,and pay attention to the adjustment of approaches and methods at the technical level.关键词
