企业破产后个人信息保护规则的协调与完善
Coordination and Improvement of Personal Information Protection Rules after Enterprise Bankruptcy—Focusing on Control-Oriented Rules
摘要
Abstract
Due to legislative neglect and the high risk of illegal activities occurring after bankruptcy,the personal information protection after enterprise bankruptcy faces significant challenges in China.Therefore,it is urgent for China to clarify the unclear rules.From a typological perspective,China's personal information protection rules can be categorized into empowerment-oriented rules and control-oriented rules.Empowerment rules grant rights or powers to data subjects and regulatory authorities to balance interests,and such personal information protection rules can be effectively connected before and after corporate bankruptcy without excessive adjustments.Conversely,control rules impose specific obligations on data processors to constrain their conduct,necessitating stronger rule coordination of personal information protection rules after bankruptcy.In this regard,the legislation should expressly stipulate that bankruptcy trustees assume responsibility for personal information protection after the bankruptcy.Particular attention must be given to data security duty obligations under control-oriented rules,establishing the content of obligations based on the consideration of the value of personal information property and variations in bankruptcy procedures.关键词
