The Legislative Dimension of Digital Justice:Semantics,Circumstances and Approaches

Abstract
Compared with the ascendant in the judicial field,digital justice seems to be rare in the legislative field.From the semantic point of view,the digital justice in the legislative scene has two levels of semantics:the tool dimension of"achieving justice through digital technology"and the value dimension of"integrating digital society to nurture justice".Starting from the life cycle of digital justice,there are three realistic situations of digital justice in the legislative field:Its demand is being shelved,its generation is"difficult to produce",and it implementation is"biased".In this regard,the digital transformation of"relationship-communication-procedure"based on the jurisprudence of Waldron's legislative procedure may be a new way to embrace the dignity of legislation and realize digital justice in the digital age.In the dimension of relationship,we need to respect the existence of differences with digital rationality,ensure the exposure of differences with digital technology,and bridge the gaps of differences with digital justice,and finally form an interactive relationship in the sense of social media.In the communication dimension,it is necessary to strengthen the expert argumentation in the formation stage of the legal case,the national argumentation in the publication stage of the legal case and the representative argumentation in the voting stage of the legal case.Finally,through the intersubjectivity of legal discussion in the digital age,the abolishment of the topic will be justified and boosted for the final legislative bill.In the procedural dimension,it is necessary to promote the deep coupling of legal due process and technical due process through the integration of ideas and concrete docking,so as to provide system supply and procedural guarantee for the realization of good law and good governance,and finally help the implementation and materialization of digital justice in the legislative field.关键词
