我国海域使用金征缴法律问题研究
Research on legal issues of the collection of sea area use fee in China
摘要
Abstract
The system of collecting sea area use fee in China plays a significant role in protecting marine resources and maintaining the ecological balance of the ocean.Although remarkable achievements have been made in the collection of sea area use fee in China,there are still legal issues such as lagging legal systems,significant disputes over the rights and responsibilities of the application subjects for compulsory enforcement,poor practical results of compulsory enforcement,insufficient legal deterrence against non-payment,and ambiguous feedback on the results of subsequent supervision.These problems seriously hinder the smooth flow of treasury funds,the effective protection and sustainable utilization of the marine ecosystem.This article analyzes the current situation and legal predicaments of the collection of sea area use fee in China,delves into the underlying causes,and proposes improvement suggestions such as perfecting the marine legal system,issuing relevant judicial interpretations,establishing a scientific and reasonable hierarchical collection mechanism,appropriately increasing the legal liability of non-payers,and actively introducing social supervision forces,with the aim of providing useful references for optimizing the collection system of sea area use fee and promoting the sustainable development of the marine economy.关键词
